Understanding Tennessee's Antisemitism and Equal Opportunity in Education Law (HB1188)
Who This Affects:
Students, Faculty, and Staff at Tennessee's Public K-12 Schools, Charter Schools, and Public Colleges and Universities
Purpose of the Law:
To prohibit discrimination and harassment based on race, ethnicity, national origin, sex, or religion, including antisemitism, within all public educational institutions in Tennessee.
Key Protections for Individuals:

Equal access to all academic programs, classes, and services

No denial of benefits or exclusion from participation due to identity

Admission criteria must not restrict access based on race, religion, etc.

Equal employment opportunities and conditions

Equal access to guidance, counseling, and financial assistance services
Note: Programs for English learners, gifted students, students with disabilities, or those with special talents are still permitted.
Antisemitism-Specific Provisions:

Antisemitic discrimination and harassment are explicitly prohibited under Title VI of the Civil Rights Act

Institutions must include antisemitism in conduct codes and anti-discrimination policies

Jewish students and employees must be equally protected
Encouraged Actions for Schools and Campuses:

Offer antisemitism awareness to students, faculty, staff, and campus security

Incorporate Jewish American Heritage curricula in courses
Title VI Coordinators must:

Investigate antisemitism complaints
-
Issue written notices for corrective action within 60 days

Report unresolved cases to the Attorney General

Submit annual reports to the Attorney General and General Assembly by June 30
Free Speech and Rights Reminder:

Criticism of Israel, when comparable to criticism of any other country, is not considered antisemitism under this law

First Amendment rights remain fully protected

Law must comply with existing federal and state anti-discrimination laws
Effective Immediately
This law is now in effect as of April 24, 2025, and promotes public welfare and ensures equity in education.
